Key Responsibilities
- To ensure that cases are accurately and efficiently processed from receipt to closure to meet the dispute resolution efficiencies
- Preparation of arbitration files:
- Check if referral meets all requirements (Heads of Argument are complete and signed by Designated Agent and Senior Agent, Compliance order issued and served on Employer, assessment entered on BIS for the contraventions and period in question).
- Check that case have been added on RADS by designated agent and approved by Senior Agent.
- Add referral on RADS and update excel list of new cases.
- Print cover page and open file.
- Issue Certificate of Outcome and Arbitration Notification and serve on Employer.
- Update Designated Agent & Senior Agents calendar with Arbitration date.
- Contact Commissioners for available dates.
- Preparation of case for the arbitration date:
- Liaise with Employer about upcoming Arbitration over the telephone, SMS, e-mail or walk-ins.
- Give Employers information about the case and the amounts outstanding.
- Assist Employers with completing the auto returns to resolve case.
- Amend assessments according to correct auto returns submitted by Employer.
- Assist Employer with Settlement Agreements.
- Communicate with employers to remind them about the Pre-arbitration date and also the Arbitration date.
- Prepare file for Designated Agent and Commissioner.
- Dealing with the case after arbitration hearing has been conducted:
- Check that all Arbitration files are returned after Arbitration hearing.
- When Awards are received from Commissioners, check that amounts on the award and the amounts on assessment correspond.
- Update assessment with Arbitration costs and payment date.
- Prepare cover letter for Arbitration Award and print assessment.
- Serve Award on Employer.
- Update RADS with outcome of case.
- Update BIS with comments on the outcome of the case.
- Updates excel comment list.
- Hand over all issued awards to Compliance Administration Department.
- Dealing with rescission/ variation applications:
- Check that Rescission / Variation applications are correctly completed.
- Inform employer that application has been successfully received.
- Update BIS with comments that employer applied for rescission.
- Inform Compliance Administration Department to put award on hold.
- Forward application to a commissioner requesting a ruling.
- Inform employer of the outcome of rescission application.
- Update BIS with comments of outcome.
- If the rescission is granted, schedule a new arbitration date and prepare and send out the notification to the employer.
- If the rescission was not granted:
- inform Compliance Administration. Department to go ahead with debt collection process, and
- notify the employer of the result of the rescission application.
- Preparation of month end reports for the Client Services Manager:
- Prepare monthly statistics of all cases scheduled for the month and forward to Operational Manger.
- Preparation of documentation for imaging and storage:
- Prepare files for imaging for easy access by Designated Agents.
- Any other ad hoc functions
- Answering any telephone enquiries.
- Assist with walk-in enquiries.
- Amend assessments where necessary.
- Grade 12
- 2 - 3 years relevant working experience in a Human Resources/Legal Environment.
- Qualification in Labour Relations/Human Resources (or relevant equivalent).
- Computer Literate and proficient in Microsoft office.
- The ability to write and speak fluently in at least two of the languages spoken predominantly in the Western Cape including isi-Xhosa.
- Excellent verbal and written communication skills.
- Prospective candidates must undergo pre-employment background checks and a polygraph examination as part of the selection process.
- Ability to speak Afrikaans fluently (Advantageous)
- Experience in Dispute Resolution administration will be advantageous.
